In order to fall under the scope of Section 667 of the German Civil Code, the payment received by an agent from a player’s former club must somehow be connected to the contract between the parties. Failing this, the commission received does not have to be handed over to the player.

1. On 4 August 2020, the Regional Court of Cologne rendered a decision ordering an agent to disclose all revenues to a player that the agent obtained from any third parties on the occasion of a transfer guided by the agent, in which he was considered to, at least, act on behalf of the player among others.
