This case concerned disciplinary sanctions imposed by the Swiss FA (Association Suisse de Football - ASF) on Olympique des Alpes SA and its sporting director Barthélémy Constantin in relation to statements made after a Swiss Super League match. The CAS did not rule on whether the remarks breached ASF disciplinary rules. Instead, the Sole Arbitrator set aside the decision on procedural grounds, finding that the ASF’s internal bodies had not sufficiently investigated key factual elements and had not ensured full respect for the appellants' right to be heard.
