RRC Sports: FFAR Face EU Law Scrutiny

On 16 July 2026, the Court of Justice of the European Union (CJEU) clarified that certain articles of the FIFA Football Agents Regulations (FFAR) are incompatible with European Union competition law and that others could hinder the free provision of services, while leaving it to national courts to decide on a case-by-case basis.

Facts and Procedure

On 16 December 2022, the FIFA Council adopted the FIFA Football Agent Regulations (FFAR), which were published on 6 January 2023. Articles 1 to 10 and 22 to 27 entered into force on 9 January 2023, and the remaining provisions entered into force on 1 October 2023.

The Applicants, a football agent and a company carrying football agency activities, brought proceedings before the Regional Court of Mainz, Germany, seeking an injunction preventing FIFA from applying several provisions of the FFAR and the FIFA Regulations on the Status and Transfer of Players to their activities.
