FIFA has no power to act ex officio to condemn a person not named as a party

In this case, the Court of Arbitration for Sport (CAS) upheld the appeal filed by Atletico River Plate by stating, among others, that there is no provision in the FIFA Regulations that allows FIFA to act ex officio to condemn a person that has never been called as a party or to consider a so-called “Intervening Party” as a party to the proceedings.

Brief facts

The player and Trencin signed a contract, valid from 1 February 2012 until 31 January 2016.

The player unilaterally terminated the contract with Trencin in January 2013.

In March 2013, Trencin filed a claim for breach of contract before FIFA, exclusively against the player.

In July 2013, the player entered into an employment contract with River Plate.

In January 2015 (i.e. “only” a year and a half later), FIFA notified River Plate of the proceedings between...
