This appeal before CAS concerned the legal characterisation of a termination declared within the structures of the Romanian Football Federation, the interaction between two employment contracts signed on the same date and the financial consequences flowing from a termination for just cause based on the player’s limited sporting participation. The Sole Arbitrator dismissed the appeal in its entirety.
Facts and Procedure
On 1 July 2023, Romanian football player Motiu Tudor (Player) and Dumbrăvița Sport Club (Club) concluded two employment contracts:
- a Standard Employment Contract using the Romanian Football Federation (RFF) form, duly registered with the RFF; and,
- a Non-Standard Employment Contract, drafted by the Club and not registered.
Both contracts were valid until 30 September 2022.
