The Court of Arbitration for Sport (CAS) dismissed the appeal of Renato Kayzer de Souza, confirming FIFA’s decision that Daejeon Hana Citizen FC was not obligated to pay the player an additional USD 400,000 under the terms of the loan agreement. The Sole Arbitrator found that the contractual clause in question required the club to take out insurance but did not establish an automatic entitlement to the insured amount. Consequently, Daejeon was only responsible for medical expenses, which had already been paid, leading to the rejection of the player’s claim.
Facts and Procedure
On 30 June 2022, Fortaleza Esporte Clube, Renato Kayzer de Souza, and Daejeon Hana Citizen FC signed a loan agreement, transferring the player from the Brazilian club to the South Korean club until 31 December 2022. As part of the deal, Daejeon agreed to pay all salary obligations during the loan period and to take out occupational accident insurance with Kayzer as the beneficiary for an indemnity amount of USD 400,000.
