According to the jurisprudence of the Court of Arbitration for Sport (CAS), the responsibility for securing work and residence authorizations primarily rests with clubs rather than players. Consequently, clubs cannot utilize their own administrative failure as a basis to invalidate the contract.

Facts and Procedure

 

On 13 September 2022, Lucca Camina Pereira and Athletic Club Ajaccien concluded an employment contract valid until 30 June 2023. The agreement stipulated that it would only become effective upon homologation by the Fédération Française de Football (FFF). It further provided that, in the absence of such homologation, the contract would become void, and neither party would be entitled to any form of compensation.
