CJEU, Case C-124/21, 21 December 2023, International Skating Union v European Commission

On 21 December 2023, amongst other major sporting cases, the Court of Justice of the European Union (CJEU) stated that several provisions enshrined in the International Skating Union (ISU) statutes were contrary to the European legal provisions as they might restrict competition, preventing athletes from freely entering those competitions they intend to, as well as negatively impacting consumers and viewers.

Context

This case deals with an appeal brought by the ISU on 26 February 2021 against the judgment of the General Court[1] (Fourth Chamber, Extended Composition) delivered on 16 December 2020 in Case T-93/18, International Skating Union v. European Commission.

The issues that need to be addressed are whether the General Court infringes Article 263 TFEU and the Court of Justice case-law on Article 101 TFEU by finding the ISU eligibility rules restricting competition by object from an antitrust point of view.
